Welcome to Vault 88. These Terms of Service ("Terms") govern your use of the Vault 88 website and your purchase of any products from us. By using this site or placing an order, you agree to these Terms. Vault 88 ("Vault 88," "we," "us") is headquartered at 16192 Coastal Hwy, Lewes, DE 19958, USA.

1. Our Products

  • Vault 88 sculptures are handcrafted works of art, hand-welded from recycled and reclaimed metal. Minor variations in texture, patina, weld detail, and color are inherent to handmade recycled art and are part of each piece's character — they are not defects.
  • Many pieces are one-of-one or numbered limited editions. Where a listing shows photographs of the actual piece, the piece photographed is the piece you receive.
  • Dimensions and weights are approximate.
  • Sculptures are decorative works of art — not toys, furniture, or load-bearing structures. Handmade metal art can include sharp edges and points; handle with care and keep away from small children.

2. Orders & Acceptance

Your order is an offer to purchase. We may accept or decline any order — for example on suspicion of fraud, a pricing or inventory error, or a shipping restriction. An order confirmation email does not constitute acceptance; acceptance occurs when your order ships. If we cancel an order, you receive a full refund. For freight-size pieces, our team contacts you to coordinate delivery before dispatch.

3. Pricing & Payment

All prices are in U.S. dollars and exclude applicable taxes, which are calculated at checkout, and any shipping charges described in our Shipping Policy. Despite our best efforts, occasional pricing errors occur; if an item's correct price is higher than the listed price, we may contact you for instructions or cancel the order with a full refund. Discount codes are limited to one per order, have no cash value, and promotional offers may be modified or ended at any time.

4. Shipping, Title & Risk of Loss

Shipping is governed by our Shipping Policy. Every shipment is insured by us until delivered; title and risk of loss pass to you upon delivery. International orders arranged by quote are subject to the destination country's customs duties and import taxes, which are the recipient's responsibility.

5. Returns

Returns are governed by our Refund Policy — the Vault 88 30-Day Guarantee.

6. Custom Commissions

Custom commissioned pieces are quoted individually, may require a non-refundable deposit, carry estimated (not guaranteed) completion timelines, and are final sale.

7. Accounts, Newsletter & Communications

You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. Information you provide must be accurate. By subscribing to our newsletter or creating an account you consent to receive emails from us; you may unsubscribe from marketing at any time using the link in any email.

8. Intellectual Property

All site content — including product photography, video, text, logos, and the Vault 88 name and branding — is owned by or licensed to Vault 88 and protected by law. Purchasing a sculpture conveys ownership of the physical artwork only; it does not transfer any copyright, reproduction, or commercial-use rights in the work or its images.

9. Acceptable Use

You agree not to misuse the site: no unlawful activity, scraping, interference with site operation, infringement of others' rights, or attempts to breach security.

10. Disclaimers

The site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the site will be uninterrupted or error-free.

11. Limitation of Liability

To the fullest extent permitted by law, Vault 88 is not liable for indirect, incidental, special, consequential, or punitive damages, and our total liability for any claim relating to a product or these Terms will not exceed the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow certain limitations; in those jurisdictions, these limits apply to the maximum extent permitted.

12. Indemnification

You agree to indemnify and hold Vault 88 and its officers, employees, and partners harmless from claims arising out of your breach of these Terms or misuse of the site.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Before filing any claim, you agree to contact us and allow 30 days to resolve the issue informally. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction. Nothing in this section limits any non-waivable consumer rights under the laws of your state of residence.

14. Changes to These Terms

We may update these Terms from time to time; the current version is always posted on this page and applies to orders placed after posting.

15. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remainder stays in effect. These Terms, together with our Privacy, Shipping, and Refund Policies, form the entire agreement between you and Vault 88 regarding the site and your purchases.
